Car insurance for amputees

Fair insurance laws for amputees have been passed in 20 states, including Arkansas, California, Colorado, Delaware, Illinois, Indiana, Iowa, Louisiana, Maine, Maryland, Massachusetts, Missouri, New Hampshire, New Jersey, Oregon, Rhode Island, Texas, Utah, Vermont and Virginia.

If you live in a state that has passed state fair insurance laws, you may be entitled to better insurance coverage than if you didn’t live in one of those states.

Each state’s law is different in terms of coverage. In nine states (Colorado, Delaware, Maine, Utah, Rhode Island, Arkansas, Indiana, Iowa and Vermont), the laws say that the insurance coverage provided for prosthetics must at least meet Medicare standards.

Medicare standards require that 80 percent of the cost of the prosthetic be covered by the plan, there’s a five year useful lifetime limit, and there are no exemptions on microprocessor devices.

In 11 states (Illinois, New Hampshire, Missouri, California, Oregon, Texas, New Jersey, Massachusetts, Louisiana, Maryland, and Virginia), the prosthetic coverage must be on par with other health services.

The coverage cannot be any more or less restrictive than coverage for other health services. In two states, California and Virginia, insurance companies do not have to provide coverage, but if they do cover prosthetic devices, the coverage must be on par with other healthcare services.

Louisiana includes a cap on coverage, which is $50,000 per limb per year.

If you live in a state with a fair insurance law, and you are denied coverage, the company may have violated the law. Some health plans are exempt from state regulations, and some companies may be headquartered in another state and may not have to comply with your state’s insurance regulations. If you believe you have been wrongly denied coverage, you should appeal, and also consider speaking with an attorney.
